Phoenix Flight Services and Phoenix Flight Training

These Terms of Service (“Terms”) govern your use of the website operated by Phoenix Flight Services and Phoenix Flight Training (collectively, “Phoenix,” “we,” “us,” or “our”), including all services, bookings, reservations, and training programs offered through the website (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

Description of Services

Phoenix provides two primary service lines:

  • Phoenix Flight Services: Includes aircraft maintenance, and aircraft management services.

  • Phoenix Flight Training: Includes ground school courses, flight instruction, pilot endorsements, and aircraft rental for training purposes.

The specific terms, pricing, and requirements for each service are detailed in the respective booking or enrollment agreements, which supplement these general Terms of Service.

Eligibility and Account Registration

  • Eligibility: By using the Services, you represent that you are at least eighteen (18) years of age and are capable of entering into a legally binding agreement. For flight training services, you must also meet all applicable Federal Aviation Administration (FAA) or other regulatory eligibility requirements.

  • Account Security: If you create an account on our website, you are responsible for maintaining the confidentiality of your account details and password. You agree to accept responsibility for all activities that occur under your account.

Payments, Fees, and Pricing

  • Pricing: All prices are subject to change without prior notice. The price quoted at the time of booking or enrollment will be honored for that specific reservation or course session.

  • Payment Terms: All payments are due upon booking or specified in your enrollment agreement. We accept all major debit and credit cards with a 3% fee, checks and cash. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service.

  • Taxes: All fees are exclusive of applicable federal, state, local or foreign taxes, duties, or charges, all of which are your responsibility.

Cancellation, Refunds, and Rescheduling

This cancellation policy applies uniformly across all Phoenix Flight Services, Flight Training sessions, and aircraft rentals.

  • Notice Requirement: All cancellations or rescheduling requests for booked time slots must be made at least 24 hours prior to the scheduled start time.

  • Tiered Cancellation Fee: Cancellations occurring less than 24 hours before the scheduled start time are subject to a cumulative, tiered fee structure, tracked per customer across all Services:

    • First Occurrence: A cancellation fee of $25.00

    • Second Occurrence: A cancellation fee of $50.00

    • Third and Subsequent Occurrences: A flat fee of $150.00, plus an additional charge of $50.00 for cancelled instructor time (if applicable), totaling $200.00 for each occurrence.

  • No Show: All no shows will be charged for the aircraft time booked and instructor time (if applicable).

  • Weather, Illness, and Safety Waivers:

    • Customer Illness: Cancellations due to verifiable customer illness will be excused and rescheduled at no charge, provided the customer notifies Phoenix prior to the scheduled start time.

    • Weather and Safety: Phoenix reserves the absolute right to cancel or reschedule any flight or training session due to unfavorable weather conditions, maintenance issues, or safety concerns, at the sole discretion of the Chief Pilot of Chief Flight Instructor. In such cases, you will be offered a full refund or a credit toward a rescheduled service, and no cancellation fee will be charged to you.

User Conduct and Prohibited Activities

You agree not to use the Services for any unlawful purpose or any purpose prohibited by these Terms. Prohibited activities include, but are not limited to:

  • Violating any FAA or other governmental rules, regulations, or laws.

  • Attempting to interfere with the security or integrity of our Services or computer systems.

  • Impersonating any person or entity.

  • Providing false or misleading information during registration or booking.

  • Any activity that endangers the safety of aircraft, personnel, or other clients.

Intellectual Property

The website, its content, features, and functionality (including all information, software, text, displays, images, video, and audio) are owned by Phoenix, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Phoenix Flight Training course materials, manuals, presentations, and digital content are provided solely for your personal training and are not for reproduction, distribution, or resale.

Disclaimers and No Warranties

  • General: The Services and provided on an “as is” and “as available” basis. Phoenix makes no warranties, expressed or implied, regarding the Services or the operation of the website, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

  • Aviation Disclaimer: All flight services and training are inherently subject to aviation risks, weather, mechanical delays, and regulatory changes. Phoenix does not warrant that flight services will operate on a specific schedule or that training will lead to certification, as this is dependent on the student’s performance and regulatory standards.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PHOENIX, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING ANY CANCELLATION, DELAY, OR ACCIDENT RELATED TO A FLIGHT OR TRAINING EVENT.

OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES IS LIMITED TO THE AMOUNT PAID BY YOU TO PHOENIX FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Phoenix, its principals, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including, but not limited to, reasonable legal fees) arising out of or related to: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation, any intellectual property or privacy right; or (d) any service provided to you, including flight services.

Governing Law

These terms shall be governed and construed in accordance with the laws of the State of Michigan without regard to its conflict of law provisions.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 5 days notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
